1. Acceptance of Terms

By accessing or using GwapaTube ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and GwapaTube.

2. Eligibility

  • You must be at least 13 years old to use the Service.
  • If you are under 18, you must have permission from a parent or legal guardian.
  • By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must immediately notify us of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.1 Ownership

You retain ownership of the content you upload to GwapaTube. By uploading content, you grant GwapaTube a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your content solely for the purpose of operating and providing the Service.

4.2 Content Representations

By uploading content, you represent and warrant that:

  • You own the content or have all necessary rights, licenses, and permissions to upload and share it.
  • The content does not infringe on the intellectual property rights, privacy rights, or any other rights of any third party.
  • The content does not violate any applicable law or regulation.
  • The content does not contain nudity, sexually explicit material, or pornography.
  • The content does not promote violence, terrorism, hate speech, or discrimination.
  • The content does not contain malware, viruses, or harmful code.
  • For AI-generated content, you have the right to use and distribute the output from the AI tools used.

4.3 Content Removal

We reserve the right to remove any content at our sole discretion, including content that violates these Terms, our Community Guidelines, or applicable law. We may also remove content in response to valid DMCA takedown notices.

4.4 Content Accuracy — AI Categorization

You must accurately categorize your content as either "AI Generated/Enhanced" or "Fully Human." Misrepresenting the nature of your content is a violation of these Terms and may result in content removal or account suspension.

5. Prohibited Conduct

You agree not to:

  • Upload content you do not own or have rights to
  • Upload content containing nudity, sexual content, or exploitation of minors
  • Upload content promoting violence, illegal activities, or dangerous behavior
  • Harass, bully, threaten, or intimidate other users
  • Impersonate any person or entity
  • Use the Service for spam, phishing, or deceptive practices
  • Attempt to manipulate the reward system (e.g., view botting, fake engagement)
  • Use automated tools or bots to access the Service without permission
  • Circumvent or interfere with any security features of the Service
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Use the Service to launder money or engage in fraudulent financial activities

6. GWAPA Token Rewards

6.1 Reward Program

GwapaTube offers GWAPA token rewards on the XRP Ledger (XRPL) for qualifying activities including video views and content sharing. Rewards are earned when specific criteria are met and must be claimed by the user.

6.2 No Financial Guarantee

GWAPA tokens are NOT an investment, security, or currency. We make no representations about the monetary value of GWAPA tokens. Token values may fluctuate and may become worthless. You should not rely on GWAPA tokens as a source of income or investment.

6.3 Wallet Responsibility

You are solely responsible for providing a valid XRPL wallet address and maintaining access to your wallet. We are not responsible for tokens sent to incorrect addresses or wallets you cannot access. Blockchain transactions are irreversible.

6.4 Anti-Manipulation

Any attempt to artificially inflate view counts, likes, shares, or other metrics to earn rewards is strictly prohibited. We actively monitor for suspicious activity. Accounts engaging in reward manipulation will be permanently banned and all pending rewards will be forfeited.

6.5 Modification and Termination

We reserve the right to modify, suspend, or discontinue the GWAPA reward program at any time, with or without notice. We are not liable for any losses resulting from changes to the reward program.

7. Membership and Subscriptions

  • Free accounts: Videos are automatically deleted 30 days after upload.
  • Paid memberships provide extended video retention and additional benefits.
  • Membership payments are processed via XRPL transactions.
  • All membership purchases are final and non-refundable.
  • We reserve the right to modify membership pricing and features with notice.

8. Intellectual Property

The Service, including its design, logos, branding, code, and non-user-generated content, is owned by GwapaTube and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without our express written permission.

9. DMCA and Copyright

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed on our Service, please see our DMCA Policy for instructions on filing a takedown notice. We process valid DMCA notices promptly and may terminate repeat infringers.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

  • We are not responsible for the content uploaded by users.
  • We do not endorse any user content or opinions expressed through the Service.
  • We are not a financial institution and do not provide financial advice.
  • We are not responsible for any losses related to XRPL transactions or GWAPA tokens.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GWAPATUBE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY USER CONTENT; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (D) CRYPTOCURRENCY OR TOKEN TRANSACTIONS; OR (E) ANY OTHER MATTER RELATED TO THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless GwapaTube and its operators, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your content; (c) your violation of these Terms; or (d) your violation of any rights of another.

13. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service ceases immediately. All pending GWAPA rewards may be forfeited.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you disagree with the updated Terms, you must stop using the Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
